Términos y condiciones

1. Agreement

These terms govern your use of MenuPress (menupress.app) and its related services (the “Service”), provided by TEXTINTEL FZE, Starcamp Global, DWTC The Offices One, Office Number 01.03, Dubai, United Arab Emirates (“we”, “us”, “our”). By creating an account or using the Service, you agree to these terms and to our privacy policy.

2. The Service

The Service reads the menus you bring in into a list you can edit, draws menu pages and themes from that list with artificial intelligence, and publishes menus you choose at a public link with a QR code. Readings and drawings are produced automatically and may contain errors, including wrong or missing items and prices. You are responsible for checking the list and every page before you use, print or publish them.

3. Your responsibility for your menu

You are solely responsible for the content of your menus, including:

• the accuracy of names, descriptions and prices;
• allergen, dietary and similar statements, including any marks such as vegetarian, vegan, gluten-free or spice level, which are your own statements and are not checked by us;
• any notices the law requires you to show, such as consumer advisories;
• your right to use any image you upload, including any menu or design you use as a reference for a look, and any logo or photo you add.

4. Accounts

You can start without signing in; your menus are then kept in an account tied to your browser, which you can lose if you clear its data. You must provide accurate information and keep your account secure. You are responsible for activity under your account. You must be at least 18 years old, or the age of majority where you live, to make purchases.

5. Subscriptions, credits and payments

• Prices, plans and credit amounts are shown on our pricing page and before purchase.
• Subscriptions renew automatically until cancelled. You can cancel at any time; access continues until the end of the paid period.
• Page credits are granted with your plan, are used as described before each use, expire as described on the pricing page, have no cash value and are not transferable.
• When your plan ends, your published menus go offline. Your content is not deleted, and the same link works again if you renew.
• Payments are processed by a third-party payment provider. Applicable taxes may be added.
• We may change prices with notice; changes apply from the next billing period.

6. Refunds

You may request a full refund of your last subscription payment within seven (7) days of the payment by contacting support@menupress.app. Each user may request a refund only once. This does not affect any rights you have under applicable law.

7. Your content

You keep all rights to the content you upload and the results created from it. You grant us a limited licence to host, process and display your content, including publicly at the link of a menu you publish, only as needed to provide the Service to you. You confirm that you have all rights and consents needed for the content you upload.

8. Acceptable use

You agree not to:

• upload content that is unlawful, infringing, abusive or that you have no right to use;
• use the Service to mislead or deceive others;
• misuse, interfere with, copy, resell or reverse engineer the Service;
• circumvent usage limits or create accounts to abuse offers.

Anyone can report a published menu. We may review reports and remove a published menu, or restrict an account, when it breaches these terms or the law.

9. Suspension and termination

We may suspend or terminate your access if you breach these terms or if required by law. You may stop using the Service and delete your account at any time.

10. Intellectual property

The Service, including its software, design and brand, is owned by us or our licensors and is protected by intellectual property laws.

11. Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error free.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the twelve (12) months before the claim. Any claim must be brought within one (1) year after it arose.

13. Changes

We may update these terms from time to time. The updated version applies from the date it is posted. Continued use of the Service means you accept the updated terms.

14. Governing law and jurisdiction

These terms are governed by and construed in accordance with Turkish law. Any dispute arising under these terms is subject to the exclusive jurisdiction of the Turkish courts.
